超法规犯罪阻却事由的理论初探

超法规犯罪阻却事由理论的引入,对我国法治的建设具有积极意义。罪刑法定原则的精神是避免突破刑法的规定处罚行为人,其核心思想是保障人权,这与超法规犯罪阻却事由理论不谋而合。在我国现有的犯罪体系下,超法规犯罪阻却事由能够自洽,并不存在体系障碍。超法规犯罪阻却事由理论将从违法与有责两个阶层阻却犯罪的成立。

The introduction of the supra-law ground for elimination of crime has had a positive effect on our legal construction. The principle of a legally prescribed punishment for a specified crime is to avoid punishing anyone beyond the criminal law,so the core idea is to protect rights of human beings,which is the same to that of supra-law ground for elimination of crime. Supra-law ground for elimination of crime can keep in harmony with our existing criminal system; there is no system obstacles. And it will stop crimes from two aspects： being illegal and taking responsibility.
