我国虽有暴力危及飞行安全罪,但适用率不高。暴力危及飞行安全罪侵犯的客体是公共安全,主观方面是过失。是否危及飞行安全应通过风险评估体系,由法官根据案件事实情节和科学因果法则判断。该罪中的严重后果不包括被施暴者的死亡重伤,但包括航空器内其他人员的死亡重伤。

Although China has set up legal provisions on the crime of violence endangering flight safety,the applicable rate of the provisions is not high.The object of the crime of violence endangering flight safety is public safety and the subjective aspect is fault.Whether flight safety is endangered should be judged by court according to the circumstances of the case facts and scientific laws of causal through the risk assessment system.The serious consequences of this crime does not cover the death or the serious injuries of the perpetrators,but the death and serious injuries of the other persons in the aircraft.
