著作财产权的宪法基础——基于宪法解释学立场的辨析

Constitutional Basis of Economic Right in Copyright: An Analysis Bases on the Perspective of Constitutional Interpretation

自20世纪以来,著作权在世界范围内呈现出财产权化的扩张倾向,但是著作财产权不仅不是宪法财产权的保护范围,反而是对宪法财产权的一种限制。从宪法解释学的立场来看,我国现行《宪法》第47条比第22条、第42条更加适合作为著作财产权的宪法基础,著作权制度是繁荣国家社会主义文化和科学事业的一种"制度性保障"。

Since the 20th century, the copyright presents a tendency towards expansion of the propertization in the world. However, economic right of copyright is a kind of restriction on constitutional property right rather than the belonging of constitutional property right. From the perspective of constitutional interpretation, article 47 of our country＇s current constitution is more suitable to be the constitutional foundation of economic right of copyright than articles 22＆42. The copyright system is an institutional guarantee for the prosperity of national culture and scientific study.
