公共领域中摄像监控的法律规制——以合理的隐私期待为视角

The Legal Regulating Under Camera Monitoring in Public Domain:In the Perspective of Reasonable Expectation of Privacy

在公共领域中,公民仍然拥有相对的合理隐私期待,但我国司法对公共领域摄像监控下的隐私权保护,倾向于否定的态度。面对现代隐私权的新挑战,司法机关需要从比例原则出发,衡量公共利益与公共领域中公民隐私权保护的协调问题,同时也有必要在立法技术层面对公共领域摄像监控进行合理规制。

People in the public domain still have a relatively reasonable expectation of privacy. Chinese judicial practice holds a conservative attitude towards public domain privacy protection under the camera monitoring. Facing the new challenge of privacy protection,judicial organs need to start from the principle of proportion measure,analyze coordination issues between public interest and citizen right of privacy protection,and regulate the public domain video monitoring reasonably in the legislative technical level.
