国外与港、澳、台地区犯罪记录规范性评价规则研究

Study on the Normative Evaluation Rules of Criminal Records of Foreign Countries and Hong Kong,Macao and Taiwan in China

对国外犯罪记录与港、澳、台地区犯罪记录规范性评价规则应采取区别对待的原则。对外国犯罪记录应根据管辖权及对等、互惠原则进行承认与评价;对港、澳、台地区的犯罪记录应相互承认,在犯罪记录评价过程中遇到的特殊问题,可通过个案协商的原则进行解决。

The principle should be obeyed about how to treat the criminal record of foreign countries,Hong Kong,Macao and Taiwan. The recognition and evaluation of the foreign criminal records should be based on jurisdiction,reciprocity and mutual benefit principle. The criminal records of Hong Kong,Macao and Taiwan regions should recognize each other,and the special problems encountered in the course of the evaluation of the criminal record can be resolved through the principle of case consultation.
