家长主义司法观下的冤错案防范

The Precaution of the Unjust and Erroneous Cases in the Judicial Concept of Paternalism

家长主义具有关爱性专制性等属性。其专制性的一面主要表现为权威性、惩罚性和求稳性,充斥在政治和社会生活的各个领域。在司法领域,家长主义的专制性则具体化为有罪推定、严厉打击、疑罪从轻等家长主义司法观,诱发了冤错案件的发生,某种程度上可以说是冤错案件产生的根源所在。因此,冤错案件的防范应当从家长主义司法观的转变和消解切入,通过国家、社会和公安司法人员的共同努力,弘扬落实平等、民主、人权的价值理念,构建符合司法规律的刑事司法制度,对家长主义司法观进行消解,从源头上防范冤错案件的发生。

Paternalism is in possession of the properties of care and autocracy.The attribute of autocracy is reflected in authority,punitive and stability, which floods the regions of politics and society.In the field of judiciary, the autocracy of paternalism is specified the judicial ideas of paternalism into such as the presumption of guilt,the severe crackdown on the suspected crime and the principle of doubtful crime lighter punishment,which gives rise to the unjust and erroneous cases.To some extent,it is the source of the unjust and erroneous cases.In order to prevent the unjust and erroneous cases,we should start from changing and lightening the influence of the paternalism judicial ideas,and promote and implement the values of equality,democracy and human right~ through joint efforts of nation,society and public security personnel.Also,we should create criminal judicial system,which accords with judicial rule,and change and eliminate the paternalism judicial ideas,so as to prevent the occurrence of the unjust and erroneous cases from the source.
