经济法制定的外部性探究

On the Externality of Economic Laws Making

在经济学诸多理论中,外部性理论是尤为重要的部分。市场经济由于自身突发性、易变性等特点,导致经济法在调整和运行中产生矛盾和困难,最终使经济法的制定转嫁给他人非自愿的负担,此种非自愿的负担,称之为经济法制定的外部性。通过经济学有关理论,分析经济法制定中的现象,探究经济法制定外部性的成因及表现,最后用外部性内在化的方式来解决经济法制定外部性问题。

In many theories of the economics, the theory on externality is a particularly essential part. The suddenness and volatility of market economy causes problems and even conflicts in adjustment and operation of economic laws and finally imposes a non-voluntary burden on others, which is called the externality of economic law making. Based on the review of relevant literature review, this paper analyses the phenomenon in the development of economic law, explores the causes and manifestations of its externality and finally proposes the internalization of externa! effects to solve the problems in economic law making process.
