网络交易平台提供服务的损害赔偿责任及规则

Compensation Liability and Rules of Online Trading Platform Providing Service

《消费者权益保护法》第44条第1款明确规定了消费者通过网络交易平台购买商品或者接受服务造成损害的赔偿责任及规则,但其针对的主要是消费者购买商品造成损害的情形,不能包括消费者通过网络交易平台接受服务造成损害的情形,因为消费者通过网络交易平台购买商品或者接受服务的情况不同。消费者通过网络交易平台接受服务造成损害,应当借鉴《侵权责任法》第9条第2款和第49条规定,适用单向连带责任规则,由服务者承担侵权责任,网络交易平台提供者承担相应责任。

In Law of the People＇s Republic of China on the Protection of Consumer Rights and Interests, Article 44 （ 1 ） has clearly stipulated the compensation liability and its rules for consumers whose legitimate rights and interests are infringed while purchasing goods or receiving services via an online trading platform. However, it mainly aims at the situations of consumers who suffer damages while purchasing goods via an online trading platform. The situations of consumers who suffer damages while receiving services via an online trading platform cannot be included. Because there are big differences between the situations of consumers purchasing goods and receiving services via an online trading platform. If consumers suffer damages while receiving services via an online trading platform, Article 9 （2） and Article 49 should be referred to. This means the rules of unilateral joint and several liability should be applied, and the service provider should assume tort liability while the online trade platform should assume corresponding liability.
