知识产权风险管理工具——专利执行保险在我国的现状评析

Analysis on the Status of Patent Enforcement Insurance of China

在美国、日本和欧盟等国家或地区,专利保险被视为企业提升知识产权风险管理水平的有效工具。作为我国一个全新的保险险种,专利执行保险近年在我国的试点工作已初具规模和成效,我国知识产权保险市场培育和保险产品的推进工作进入了新的发展阶段,但同时也存在着若干问题。因此,在及时总结近年来试点工作的成果和经验的同时,审视其中存在的问题和不足,思考相关对策,将为我国之后的政策制定或调整工作提供有益的参考。

Patent insurance is considered an effective tool to manage and control the risk of intellectual property right of enterprises in the U. S. , Japan and EU. The experiment of the patent enforcement insurance which is a new insurance product in China has made some progress since several years ago. The signing of ＂Intellectual Property Insurance Strategic Cooperation Agreement＂ on July 21,2014 in Beijing marks that the market cultivation and the product design of intellectual property insurance have entered a new stage of development. At this time, it＇s significant for us to sum up the experiences and examine the shortcomings in the past two years to provide a reference for future work.
