The New Tendencies of International Law

当前国际法发展呈现两大趋势:首先,大量的国际法寻求突破其"软法"的特性,向"硬法"转变的趋势加强。这一趋势在比较成熟的国际法领域,诸如国际贸易法、国际刑法、国际劳工法以及国际海洋法等表现非常突出。其次,国际法的适用范围不断扩大,国际法律规范由分散向逐步统一的趋势凸显。科学技术、经济贸易和国际组织的发展和完善构成了国际法统一的基础,国际法在全球范围内统一的现象明显,比较法学的复兴在法律统一方面起到了重要作用。

Two tendencies have been presented in the development of the international law： firstly, the tendency of the international law transforming from the ＂soft law＂ to the ＂hard law＂ is being accelerated, especially in such areas as the international trade law, in- ternational criminal law, internationallabour law and the international law of the sea. Secondly, the tendency of the international law shifting from decentralization to unification is being enhanced. With the development of science and technology, economy and social or- ganizations, the unification of international law as a universal phenomenon is appearing in many fields of international law, in which the comparative law plays a significant role.
