摘要
商标许可有利于许可人利益最大化,也有利于被许可人借助他人品牌打开市场。利益分享虽然建立在利益平衡的基础之上,但与利益平衡又有所区别,利益分享不仅存在于双方合作的过程中,还延伸至合作结束之后的合理期限内,且不能损害消费者的合法利益。
Trademark licensing is conducive to maximize the interests of the licensor, and the licensee can use another brand to open markets. Although the benefit-sharing is established on the basis of the interests balancing, there are differences between benefit-sharing and the interests balancing. Benefit-sharing not only exits in the process of cooperation between both parties, but also extends to a reasonable period after expiry of cooperation and exerts no harm to the legitimate interests of consumers.
