对特惠贸易协定设置开放准入条款的思考——以RCEP协定谈判为例

Some Thoughts on Open Accession Provisions in PTAs:Take RCEP Agreement as Example

近年来,特惠贸易协定呈现出多边化的趋势。诸如TPP、TTIP、RCEP协定在内的一些多边特惠贸易协定,以设置开放准入条款的方式,以求符合WTO关于特惠贸易协定的规范。在开放准入条款的设置中,既存在一些积极因素,又会面临一些实际问题。如何在特惠贸易协定中设置开放准入条款,特别是如何处理其与关税减让安排的关系,将直接影响协定的多边化和区域经济一体化的进程。

PTAs have presented the trend of multi- lateralization in recent years. In complying with the WTO norms on PTAs,PTAs like TPP,TTIP,and RCEP,set open accession provisions. There are both active factors and realistic problems in setting up the open accession provisions in PTAs. How to set up open accession provisions in PTAs,and how to deal with the relationship between the open accession provisions and tariff reduction arrangements,will have direct impacts on the process of PTAs' multi- lateralization and regional economic integration.
