摘要
随着新《民事诉讼法》和《环境保护法》的颁布,环境公益诉讼制度在我国正式确立。长久以来有关环境公益诉讼原告资格的争论从未休止过,其中对环境保护主管部门和其他负有环境保护监督管理职责的部门(简称环境管理机关)原告资格的分歧较大。笔者认为,虽然环境保护法的修改意在与民事诉讼法进行衔接,但是其中对于环境公益诉讼原告资格的规定却没有把握住民诉法第五十五条的立法原意。仅仅将环境公益诉讼的原告资格赋予公益性社会组织的做法还有失偏颇。因此要扩大环境公益诉讼的原告范围,即赋予环境管理机关环境公益诉权更具优越性,这样不仅可以提高司法效率、有效保护环境公益,而且还对推动环境公益诉讼的发展具有重要意义。
The environmental public interest litigation system in China was formally established along with the enaction of the new Civil Procedural Law and Environmental Protection Law. The debate on plaintiff qualification in environmental public interest litigation has never stopped, among them the debate on plaintiff qualification of the environmental protection authority and other departments responsible for environmental protection supervision and management (hereinafter referred to as the environmental management authorities) is fiercer. Although the amendment of Environmental Protection Law aims to link with Civil Procedural Law, it has not grasped the legislative intent of Article 55 of Civil Procedural Law. It is a bias to vest the plaintiff qualification of environmental public interest litigation only to the public welfare organization. The plaintiff qualification scope should expand to include the environmental protection authorities, improve the judi- ciary efficiency, protect public interest, and promot the development of environmental public interest litigation.
