在执行工作中,不可避免地会出现变通执行依据的情形。变通执行依据是指在民事执行时,基于各种原因,尤其是执行案件的需要,对其所依据的生效裁判文书认定的事实、内容、结果等予以一定范围内的变通。包括采纳新的事实依据、扩展裁判文书的内容、变通执行三种形式。变通的原则包括合法性原则、关联性原则和程序性原则。对于变通执行依据制度的构建,则应置于新一轮审执分离的大背景之下,明确这一权限的行使部门,探索分段管理与垂直管理的基本构架,并不断优化相应变通程序。
