对中止犯减免处罚所根据的观点如何,直接影响着中止犯的成立范围。因此,就中止犯减免处罚的根据进行前提性研究有着重要意义。一方面,中止犯之所以减免处罚是因为行为人违法性或有责性的减少;另一方面,对于中止犯刑事政策的理解不能停留于表面。因此,对中止犯减免处罚的根据是以行为人违法性或有责性减少为内容的刑事政策说。
