试论中国特色宪法监督制度的特征、依据及发展空间——兼论《立法法》修订相关条款

On Characteristics, Foundation and Development of Constitution Supervision System in China

我国现行《宪法》《立法法》共同确定了中国特色的宪法监督制度,其基本特征是:合法性与合宪性审查合一,体系内自我审查与纠正为主,广泛地启动和建议启动权利。2015年3月15日通过的《立法法》修正案全面加强了以这一特征为核心的宪法监督制度。我国宪法监督制度源于我国国家基本制度和国家法治发展的阶段性实际,当然存在进一步发展的巨大空间。

The current ＂Constitution＂ and ＂Legislation Law＂ in China jointly determine the constitutional supervision system with Chinese characteristics. The features are： review of unity of legality and constitutionality, self-censorship and correction within the system, inclusive rights of start and suggestion to start. The Amendment of ＂Legislation Law＂ adopted on March 15th2015 strengthened the Constitutional Supervision System with these core features. Constitutional Supervision System in China is formulated with the basic systems and national development of rule of law and there will be huge space for further development.
