数字技术和互联网的发展,极大改变了音乐产业发展模式,在由传统的唱片经济向新模式转变的过程中,录音制品制作者承受着黎明前的阵痛。归其原因,不是录音制品制作者广播权等的缺失,而是现行权利没有得到落实。对处于转型期的音乐产业来说,当务之急是顺应技术发展的需要,探求新的发展模式,而非扩大录音制品制作者的权利,何况该权利在中国难于实施已有历史经验的证实。

The development of digital technology and network has greatly changed the development mode of music industry.The producers of phonograms are experiencing pains and hardness with the traditional economy of phonograms shifting to the new mode, which is owing to the non-implementation of the existing rights, not lacking in the broadcasting right. For the music industry in the transition period, the first thing to do is to conform to the needs of technological development and explore new development mode, but not expanding the rights for producers.
