准格尔旗农村土地权属争议及调处方式探讨

Research on Rural Land Ownership Disputes and the Solution in Zhungeer County

农村土地权属争议的调处,是关系我国社会稳定的一项重要工作。本文统计、归纳准格尔旗的农村土地权属争议案例及其所属类型,得出农村土地权属争议产生的原因,即立法层面的原因、经济层面的原因,及其它包括历史遗留问题、权属管理的滞后性和缺乏规范等方面的原因。结合典型案例,本文分析了三种不同的争议调处方式,并对比其优缺点。协商解决的优点在于双方直接沟通、快速解决问题,有利于节约社会资源;行政裁决方式解决纠纷快捷有效,既节约社会成本,又可以减轻法院的负担;司法途径是将争议矛盾推到上级部门,即法院去解决。在此基础上,本文进一步提出完善农村土地权属争议解决途径的建议,为政府部门完善农村土地权属争议调处机制提供参考依据。

The mediation and resolve of the rural land ownership disputes is essential for the social stability of our country. Based on the statistic of types of the rural land ownership disputes in Zhungeer County, this paper analyzes the causes of that which include the causes in legislative level and economic level, and other issues including historical issues, lags in ownership management and lack of criterions and so on. This paper analyzes advantages and disadvantages of different dispute mediation and resolve ways by analyzing some typical cases. The advantage for Negotiated settlement is rapid problem solving which saves social resources; Administrative adjudication is efficient dispute settlement, the social cost is also saved, and can reduce the burden of the court; The judicial way is handing disputes to the superior departments, namely the court to solve. Based on these analyses, this paper puts forward some advices for government to improve the mechanism of the mediation and resolve of the rural land ownership disputes.
