A Cognitive-Linguistic Analysis of a Direct Examination by the Defense Lawyer in the Case of Zhang Jun Abandoning His Baby:Based on Script Theory

运用脚本理论工具对"上海张军弃婴案"中的辩护律师和被告人之间的一段直接询问进行认知语言学分析,以揭示辩护律师怎样通过询问,激活和重构储存于庭审法官脑海中的脚本图式,从而改变法官对被告人犯罪行为的认知态度,并最终赢得有利于被告人的判决。律师的庭审话语充满着各种方式的认知操控,而认知语言学的各种分析手段(包括脚本理论)可以用来对庭审话语进行更加深入细致的分析。

Finally, this paper concludes that a defense lawyer＇s trial talk is pregnant with various types of cogni- tive manipulation, and analytic tools of all descriptions developed in cognitive linguistics, including script theo- ry, can be effectively used to make an in-depth analysis of courtroom discourse.
