生态补偿鉴定制度的建立健全是完善生态补偿相关立法的重要环节。当前国内有关生态补偿鉴定的理论和实践仍处于探索阶段,其法律概念、法律关系等问题亟待明确。通过渤海湾康菲溢油事件和福建省江河流域生态补偿实践等案例,分析了在我国明确生态补偿鉴定法律关系的必要性。以马克思主义生态观、程序的两个价值观等理论,揭示出确立生态补偿鉴定法律关系的理论依据,在厘清生态补偿鉴定法律关系概念的基础上,阐明了生态补偿鉴定法律关系的内涵,为生态补偿鉴定制度的立法实践做了初步的理论准备。

The theory and practice of ecological compensation appraisal is still at its exploratory stage in China. bomethmg must be done to clarify the core legal concept, the specific legal relationship and other key issues. The author analyzes the necessity and importance of establishing the legal relationship of ecological compensation appraisal with the cases such as the ＂Conocophillips oil spilling accidents＂ and the ＂Fujian ecological compensation of the river basin＂. According to the Marxism＇s ecological theory and the theory of two sorts of process value, the author proposes the theoretical basis for establishing the legal relationship of the ecological compensation appraisal. Finally, with the clarified concept, the author gives the connotation of the legal relationship of the ecological compensation appraisal.
