医疗纠纷诉讼中的专家辅助人

The expert assistant in medical malpractice lawsuit

具有专门知识的人以专家辅助人的身份参与民事诉讼在民事诉讼证据的相关规定中早有规定,但实践中具有专门知识的人在医疗纠纷的案件中参与诉讼的情形并不理想。随着《民事诉讼法》和《最高人民法院关于适用<中华人民共和国民事诉讼法>的解释》(以下简称"民事诉讼法司法解释")对具有专门知识的人出庭参与诉讼的进一步规定,可以预见到在医疗纠纷案件中具有专门知识的人作为专家辅助人出庭参与诉讼的比率将会提升。本文通过对具有专门知识的人身份的界定,探讨医疗纠纷诉讼案件中专家辅助人的资质和地位,指出专家辅助人在医疗纠纷案件中的作用。

The Civil Procedural Law allows a party concerned to apply for a person with special knowledge to make explanation on a special issue or to inquiry the authenticator.However,the proportion of the expert assistant taking participate in medical lawsuit is not ideal in practice.With the modifications of civil procedural law and the relevant laws,it can be foreseen that the proportion of the expert assistant taking participate in medical lawsuit will rise.This paper mainly analyzed the status of person with special knowledge in medical lawsuits,and explored the qualification of expert assistant in medical lawsuits.Also it further pointed out the role of expert iassistant n medical lawsuits.
