农村留守女童遭性侵后的生育权保护研究

Study on the Reproduction Rights Protection for the Left-behind Rural Girl Victims of Sexual Assault

随着大量农村劳动力涌向城市,一个特殊的社会群体农村留守儿童随之出现,其中农村留守女童遭性侵后怀孕产子问题引起社会广泛关注与讨论。农村社会的性别歧视思想、监护的不到位及相关法律的空白等诸多因素,导致农村留守女童遭性侵后生育权问题的出现。从农村留守女童遭性侵后产子的典型案例入手,引出对农村留守女童这类特殊群体生育权的法律保护。通过明确农村留守女童生育权的法律界定,分析农村留守女童遭性侵后生育权受到侵害的原因,针对问题及原因对农村留守女童遭性侵后生育权法律保护的对策进行全面的探讨,提出完善相关法律制度体系的建议,实现对农村留守女童合法权益更好、更全面的保护。

The rural left behind children, as a special social group, emerges with the mass rural labor force flocking into the cities and are paid extensive attention and discussion by the society for their problems of pregnancy due to sexual assault and giving birth. The problems of reproduction rights for the left-behind rural girl victims of sexual assault are caused because of the gender discrimination thinking in rural areas, insufficiency of guardianship, no relevant laws and so on. The article introduces the legal protection on the reproduction rights of this special group of the left-behind rural girls, from the typical cases of their sufferings of sexual assault and giving birth. Through the clear legal definition of the reproduction rights for rural left-behind girls, this article analyses the reasons of violation of reproduction rights for the rural girl victims of sexual assault, aiming at the problems and reasons, introduces generally measures to protect legally the reproduction rights of the rural left-behind girl victims of sexual assault, and comes up with suggestions to perfect the relevant legal system and to realize the better and more comprehensive protection of legal rights of the rural left-behind girls.
