Explore the Legal Personality of the Proprietor Assembly

物业的所有人就是业主,一个物业小区的全体业主可以依法成立业主大会,业主大会在民事活动中的民事主体地位在民事诉讼中的地位享有的民事权利和承担的民事义务等问题,我国相关法律、法规未有明确的规定,与我国法律体系还有不和谐之处。本文试图通过授予业主大会社会团体法人资格来解决这一问题。

Property owners become home owners,all proprietors can establish the proprietor assembly by law,the proprietor assembly enjoy civil rights and obligations assumed by models in civil activities.our related laws and regulations did not clearly defined,on the contrary,there are tensions with our legal system,the paper tries to address this issue by granting legal personality of the proprietor assembly of social groups.
