工程建设征地补偿和移民安置条例实施后评估

Post- evaluation of implementation of Regulations on Land Requisition Compensation and Resettlement for Large and Medium- sized Water Conservancy and Hydropower Projects

为做好大中型水利水电工程建设征地补偿和移民安置工作,国务院于1991年颁布了第一部水利水电工程移民管理法规——《大中型水利水电工程建设征地补偿和移民安置条例》(以下简称《条例》),并于2006年修订。《条例》实施对规范我国征地补偿和移民安置工作发挥了建设性作用,但随着经济社会快速发展,也逐步暴露出某些不适应现实的问题,有必要对实施情况进行评估。通过建立评估指标,从立法质量评估和主要制度评估两个方面对《条例》实施情况进行了评估,针对出现的问题提出了《条例》修订的建议。

To improve the work of land requisition compensation and resettlement for large and medium - sized water conser- vancy and hydropower projects, the State Council issued the first administrative regulations on resettlement for water conservancy and hydropower projects, namely Regulations on Land Requisition Compensation and Resettlement for Large and Medium - sized Water Conservancy and Hydropower Projects in 1991 and revised in 2006. Despite its constructive role in standardizing the work of land requisition compensation and resettlement, the regulations becomes unaccommodated to the reality due to the fast development of the society and economy, and hence needs an evaluation of its implementation effect. The implementation of the regulations is evaluated from two indexes ： the legislation quality and major framework, and suggestions on the revision of the regulations are proposed according to the problems of the implementation.
