摘要
2015年11月5日,《跨太平洋伙伴关系协定》(TPP)最终文本对外公布,备受关注的知识产权章节在客体范围、权利保护期限、知识产权执法、司法力度等标准上明显超越了TRIPS以及诸多FTA的规定,具有TRIPS-PLUS条款的性质。然而TPP的高标准并非我国未来知识产权事业发展的障碍。我国应当在考虑国情和公共利益的基础上,内化改革、外促合作,争取在知识产权国际谈判中的话语权,客观积极地应对TPP之TRIPSPLUS条款,以免受发达国家牵制而陷入被动。
The final text of "Trans-Pacific Partnership Agreement" (TPP) was released on November 5, 2015. The muchwatched intellectual property chapter concerning on the scope of the subjects, the extension on the term of protection, the enforcement and judicial procedure of IP law, these standards became TRIPS-PLUS because of significantly beyond the TRIPS as well as many provisions of the bilateral free trade agreement (FTA). However, TPP's high standards of IPR will not be an obstacle to the future development of our business.We should take national conditions and the public interest into consideration when promoting the reforms inside and cooperation outside. What's more, we must seek the right to speak in international negotiations in the intellectual property rights and respond to the TRIPS-PLUS actively. Avoiding being pinned by developed countries.
