大审判格局下我国知识产权法院的探索与完善 以台湾地区为视角

Big Trial Pattern under the Court's Exploration and Perfecting of Intellectual Property Rights in China- In the Perspective of the Taiwan Region

成立知识产权专门法院,是我国知识产权司法保护进程中的里程碑事件。当前,我国内地知识产权法院建设刚刚起步,台湾地区早在2008年就已成立知识产权专门法院,在知识产权专门审判方面积累的一些经验值得我们研究和借鉴。未来知识产权法院应当进一步完善顶层设计和系统规划,以成立知识产权上诉法院为目标。另外,知识产权法院还应当完善知识产权法院的审判组织人员结构,建立司法机关和行政部门沟通机制。同时,对于进一步完善专利侵权诉讼与专利宣告无效程序的冲突解决机制,需要研究和探讨。

The establishment of specialized IP courts, is China＇s judicial protection of intellectual property fights in the process milestones. Currently, the construction of the intellectual property court China's Mainland has just started, Taiwan, early in 2008 had set up specialized IP courts, some experience specializing in intellectual property accumulated trial worthy of our study and reference. Future intellectual property court shall further improve system level design and planning, to the establishment of the Court of Appeals for the goal of intellectual property fights. In addition, intellectual property trial court should also improve the organizational structure of the intellectual property court personnel, the establishment of the judiciary and the executive branch communication mechanism. Meanwhile, to further improve the patent infringement litigation and patent invalidation procedures conflict resolution mechanisms need to be studied and discussed.
