The Legal Risks of Financial Derivatives in China and Countermeasures

世界各国的经济文化背景不同,金融衍生工具法律风险的表现各异。文章对我国金融衍生工具的法律风险问题进行了分析,指出我国金融衍生工具的法律风险的存在,有其客观原因,目前加强相关对策的完善,势在必行,为金融衍生工具的顺利稳妥推出,具有积极推动作用。由此得出的政策启示是:加强国际合作;加强金融衍生工具相关的法制建设;加强风险价值宣传,及时披露风险信息;加强宏观调控。

The financial derivatives of legal risk are different due to the different economic and cultural background. We analyzed the financial derivatives risk problems in China, and pointed out that the existence of the legal risks of financial derivatives in China has its object reason, we can strengthen the perfection of related countermeasures at present for the smooth operation of the financial derivatives and safe launch. And the resulting policy implications are： international cooperation, to strengthen the financial derivatives related legal system construction, introduce legal risk, risk disclosure and macro regulation.
