Codification of a Civil Code of Commercial Character

民法典编纂面临着如何处理民商关系的问题。从我国的实际情况出发,应当坚持"民商合一"制,民法典应当充分反映市场化改革的本质要求,为商事法律制度提供精神的支撑和制度的基础。编纂这样一部反映市场经济要求的商事品格的民法典,符合改革开放以来民商事立法的实际情形,也符合新形势下全面深化改革的远景目标,是实现民商事法律体系化的不二选择。

The codification of a Civil Code faces the problem of how to deal with the relationship between civil and commercial matters. From China＇ s actual situation, we should adhere to the combination system of Civil and Commercial Codes, moreover, the Civil Code should adequately reflect the essential requirements of market-oriented reforms and provide spiritual support and institutional basis for commercial law system. Codifying such a Civil Code of commercial character reflecting the requirements of market economy is suitable to the actual situation of civil and commercial legislation since the reform and opening up, also is suitable to the future target of comprehensively deepening reform under the new situation. Therefore, in addition to such codification, there are no alternatives to realize civil and commercial legal systemization.
