摘要
"以法为教,以吏为师"。校园庭审作为一种新型法学教育模式,与传统意义上"模拟法庭"教育的主要区别是从拟态教育模式转向"拟态+现实"教育模式。这一模式使得法律的教育对象从法律的效力对象扩展到法律的非效力对象,实现了法学职业教育从拟态环境教育到现实环境教育的转化,型构出一种新型的法学教育模式。这种新型教育模式的表达式是:S教师(职业教师+职业法官)—O教材(教科书+法典+现实审判)—R学生(课堂听讲者+职业模拟者+庭审旁听者),这一新型教育模式的型构对法学高等教育提出了"重点培养学生法律再发现能力"的客观要求。同时,这种新型法学教育模式促进了司法制度与法学教育制度的深度契合。
"Take law as the teaching material and officials for teachers". The major difference between the new campus court trial law education and the traditional "moot court" law education is that the new pattern transforms the traditional mimetic education mode to the new "mimetic plus realistic" education mode. This new education mode extends the validity boundary of the law from objects to non-objects, thus converting the pseudo-environment education into the actual environment education. The pattern also develops a new relationship between teachers and students and the formula of the new relationship is: S Teachers (professional teachers and professional judges) -O Course Materials (text books, the code and real trials) -R Students (audiences of the lectures, professional simulators and audiences of the courts) The new relationship raises an objective requirement of "emphasizing the student trainings of the law redis covery capability" in high level law education. Meanwhile, the new law education pattern promote combi nation between the legal system and law education system with depth.
