舆论监督与司法独立的冲突与平衡——以“媒体审判”为视角

On conflict and balance between public opinion supervision and judicial independence— In view of the Media Trial

近年来,司法实践中出现了一种称之为"媒体审判"的现象,其背后隐含着舆论与司法的冲突。"媒体审判"在一定程度上与司法独立的理念相冲突,阻碍了司法公正的实现。舆论监督和司法独立之间的冲突与平衡是当前一个阶段我们所必须正视和需要解决的问题。在分析"媒体审判"现象产生的原因和其所凸显出来的舆论监督和司法独立冲突的基础上,提出平衡舆论监督和司法独立之间关系的对策,进而实现舆论监督与司法公正的双重价值目标。

In recent years,media trial phenomenon occurred in the judicial practice,which implies the conflict between public opinim and judrcature. To some degree,medal trial is contrary to the judicial independence,and hinderes the realization of judicial justice. The conflict between the supervision of public opinion and the independence of the judiciary is an urgent problem to be solved,interaction between the supervision of public opinion and the judicial. Based on the causes caused by Medial Trial,public opinion superrisim reflected by Medial Trial and the cunflicf of judicial indcperdcnce,this thesis puts farward the countermeasures in order to realize the the supervision of public opinion and the judicial fair.
