摘要
我国工作时间基准体系成型于上世纪90年代中期,至今已运行20年并未有任何系统修订,难以有效应对实践中普遍存在的长时间工作、无序加班等问题。为此,应当从市场化的劳动关系本质出发,厘清现有工时制度的内在矛盾,界定工作时间的概念内涵,确立工时法制的调整边界,以指导司法裁判。工时基准法制的立法完善应沿袭现有的标准工时规定,细化特殊工时的适用范围并强化保障手段,实现工作时间调整的法治化。
The China's labor standard legal institution of working hours took shape in the mid- 90 s,which has already been operating for 20 years without any amendments. The result is such system could not effectively deal with the widespread issues in practice such as long working hours and overtime working. Therefore it is necessary to solve the inherent contradiction of current working hour legal system according to the nature of market- driven labor relationship as well as define working hour,which thus establish the regulation edge and instruct judicial adjudication. The reconstruction of working hour legal system should reserve current standard hours rule,refine the application range of non- standard hours and strengthen protective measures in order to realize the legalization of working hour regulation.
