论企业刑事风险的防范——以非法吸收公众存款罪为视角

市场经济的蓬勃发展离不开企业的参与,新公司法对注册公司资本登记条件的修改,更是让设立公司的门槛大幅度降低。在大力创新与科学经营的同时,我们还应注重企业法律风险的防范。目前,我们对企业民事领域的风险防范已经有很多研究,但是对企业刑事领域的风险防范还稍显不足。以非法吸收公众存款罪为视角,主要论述企业在非法吸收公众存款罪方面的风险防范,以帮助广大企业依法经营,避免踏入刑事犯罪的雷区。

The booming market economy can not do without participation of enterprises. The modified conditions for capital registration of registered company in the new company law make a significant reduction in setting up a company. During the time of strong innovation and scientific management, we should pay attention to prevent legal risks of the enterprises.Currently, we have done a lot of research in the field of civil risk prevention, but less research in the field of criminal risk prevention of the enterprise. From the perspective of crime of illegal deposits from the public, the paper focuses on the risk prevention in terms of crime of illegal deposits from the public, in order to help the enterprise do the business by law and avoid stepping into criminal offenses.
