论指定居所监视居住的执行监督

On the supervision of the execution of assigned residence under surveillance

《中华人民共和国刑事诉讼法》的第二次修改,对监视居住进行了很大的修改,首次提出了指定居所监视居住的强制措施,为保护犯罪嫌疑人、被告人的人权,修改后的刑事诉讼法规定人民检察院有权对该措施的决定与执行的合法性进行监督。通过对指定居所监视居住执行过程中存在的诸多问题加以分析,在制度层面及执行监督层面提出了几点建议。

The second revision of ＂Criminal Procedure Law of People＇s Republic of China＂ has made a great change in the residential surveillance, and proposed the enforcement of assigned residence under surveillance for the first time for protecting the human rights of the suspects and the accused. The revised Criminal Procedure Law provides, the people＇s procuratorate have the right to supervise the decision of the measure and the legality of the execution. Through an analysis of the problems during the execution of assigned residence under surveillance, the paper put forward some suggestions at the institutional level and the supervision level of execution.
