摘要
运用委托代理理论,分析了代孕行为中的委托代理问题,这些问题包括生产之前"代孕母亲"对胎儿照顾不周以及生产之后"代孕母亲"拒绝将孩子交付委托夫妇。"局部代孕"与"完全代孕"的委托代理问题程度不同、各有侧重。解决代孕中的委托代理问题要求我们制定与完善相应的法律法规,确定代孕协议的法律地位。
Based on principal-agent theory,the principal-agent problems in surrogacy are analyzed. These problems include the‘surrogate mother＇ doesn＇t take care of the baby thoughtfully before childbirth and refuses to deliver the baby to the intending parents after childbirth.‘Partial surrogacy＇ and ‘full surrogacy＇ have different degrees and aspects of principal-agent problems. To solve the principal-agent problems in surrogacy,we must make and improve corresponding laws to make sure the legal status of surrogacy agreements.
