论秦汉“名田宅制”中的“诸不为户”

张家山汉简《二年律令》中含有大量关于土地制度的法令,对于西汉前期"名田宅"的具体实施方法和土地犯罪行为惩罚尤为详细,对于犯罪对象则很少涉及。《二年律令·户律》中"诸不为户"阐明了在何种情况、何种人群中,会出现简文中所惩罚的土地犯罪行为。

Laws of the Second Year of Empress Lǜ recorded a mass of laws on land system,implement method of the MING TIAN System of the Han dynasty,particularly detailed land crime punishment,for the crime object is rarely involved. To study the land crime problem of Han Dynasty more clearly,it must be integrated with the help of the literature handed down from ancient times.
