浅析职务犯改造对策

Countermeasure Analysis to Duty Criminals' Reformation

当前,我国针对职务犯监管与教育的理论研究正在逐步增多,但从整体来说仍处于摸索阶段,相对于职务犯罪预防和惩治研究领域的炙手可热,职务犯改造机制研究则相对为学界所忽视。不可否认职务犯作为一个客观存在的群体,对于刑罚执行的监狱来说,面临着职务犯改造的巨大挑战。笔者联系实际的职务犯管教需求,详细分析了当前职务犯改造中的突出问题,归纳出职务犯改造的基本规律和经验,提出创新职务犯的刑罚执行对策研究,已达到职务犯教育改造的最终目的。

At present,the theoretical researches of supervision and education of duty criminals are growing in our country.However,it is still felling its way as a whole. Moreover,comparing to the prevention and punishment of duty criminals which is popular in China,the research of its reformation is relatively less in academia. Without doubt,they are objective group,which become a great challenge of reformation to penalty execution in prison. However,duty crime is not only provided with the nature of itself but also with special subjective characteristics. And the basic rules and experience of duty criminals reformation can be concluded through connecting practical demand of duty criminals＇ remedial treatment and analyzing all kinds of characteristics in duty criminals expressed in the period of prison remolding. Also,it puts forward the countermeasure research of duty criminals＇ penalty execution in order to educate and reform the duty criminals.
