摘要
随着社会经济的发展和法治的不断进步,我国刑事辩护律师在法律长河中担任了100多年的刑事案件司法正义的守护神,刑事辩护律师为实现司法公正和正义做出了重要的贡献。然而,刑事辩护律师的职业环境却不容乐观,经历了相关法律的多次修改,使得刑事辩护律师的职业定位和职业使命经历了较大的变迁。有人说他们是戴着镣铐的舞者,也有人说他们是游走在法律刀刃上的人,面对这样的职业环境的挑战,笔者通过访谈以及问卷调查的方法,以绥化市北林区部分刑事辩护律师为调查对象,对刑事辩护律师权利困境展开调研。本文将结合访谈的内容以及问卷的情况进行分析,为刑事辩护律师的权利及其保障提出合理的建议和对策。
With the continuous progress of the economic and social development and the rule of law and China＇s criminal defense lawyers in legal history,which is served as the patron saint of 100 years of criminal cases of judicial justice. Criminal defense lawyers for the realization of judicial justice and justice made an important contribution. However,the professional environment of the criminal defense lawyer is not optimistic,experienced the relevant laws of many changes,making the criminal defense lawyer career position and career mission experienced a big change. Some people say they are wearing shackles of dancers,also someone says they are wandering in the edge of law,in the face of such a professional environmental challenges,the author through interviews and questionnaire survey methods. Suihua Beilin District,part of the criminal defense lawyers as the research object,on the rights of the criminal defense lawyer investigation. In this paper,it presents the content of the interview and the analysis of the situation of the questionnaire,for the criminal defense lawyer＇s right. It also expounds its protection to put forward reasonable suggestions and countermeasures.
