摘要
在当下我国城镇化快速发展阶段,围绕我国土地征收制度改革所预设的诸多理论和政策方案,因缺乏对这一制度本质的深刻透视,难以真正地实现改革的突破。立足我国现行地权结构形态,我国土地征收权的行使,本质上乃土地开发权实现方式的具体体现。现有制度安排和规范设置排斥了被征地人积极参与土地开发权价值实现的过程。突围这一困境,须立足于土地开发权视角,建立被征收土地之开发权优先购买权法律制度,以保障被征地人优先获得被征收土地的土地开发权,从而使其能够积极参与土地开发权价值之实现的过程,以避免征地后的一次性货币补偿所带来的诸多风险,进而有效地实现被征地人利益的长期保障。
In the rapid development stage of urbanization in our country, revolving around theories and policies of reform of China's land expropriation system, due to the lack of profound perspective of the system nature, it is difficult to get the breakthrough in the reform. The existing institutional arrangement and regulating device repels participation and realization of land development right value for the landless people. To get out the plight, be based on the land development rights perspective and establish legal system of first purchase right of land development right to ensure the landless people's priority of land development right and make them actively involve in realization of land development right value, in order to avoid risks after one-time monetary compensation and effectively realize the interests of the landless people's long-term security.
