摘要
法治政府建设是全面依法治国的核心内容,也是实现中华民族伟大复兴及中国梦的必经之路。我国改革开放30多年来法治建设及组织考评的演进历程,历经了多个阶段,呈现出不同特征,这一过程有效地促进了法治政府建设,但其本质上还是目标性考评。目前存在的目标导向及功能定位不明确、技术体系不完善、动力机制不健全等问题,甚至形成各自为政、重复考评、无所适从等现实困境,都肇源于考评理论悖论、考评主体单一、制度建设滞后、顶层设计缺失等因素。基于价值理性与工具理性的双重耦合,以政府绩效评价推进法治政府建设既体现了法治精神及政府绩效的价值理性,又强化了考评作为组织管理的工具属性,有助于提升治理的合法性。未来应创新评价理论,扩大公众参与,引入多元评价主体,完善技术体系,加强制度建设,培育绩效文化。从目标考评到法治政府绩效评价的转变,有助于衍生一门新的学科——法治政府绩效评价学,从而进一步推进我国公共管理理论跨学科的融合与创新。
The construction of governments of rule of law is the core of all-round rule of law,and a must road to realize the great renewal of the Chinese nation and the Chinese Dream.Over three decades since the reform and opening to the outside world in 1978,the evolving course of construction of rule of law and organizational appraisements in China has experienced several phases,showing up various characteristics.This course has effectively boosted the construction of governments of rule of law,but in essence it is still objective evaluation.Many existing problems,including unclear goal orientation and functional orientation,defective technical systems,deficient impetus mechanism,and even the predicament in reality such as the lack of coordination,repeated appraisements and disorientation,are all caused by the factors of paradox in appraisement theory,single appraisement subject,sluggish institutional construction,and the lack of top-down design.On the basis of double coupling of value rationality and instrumental rationality,to boost the construction of governments of rule of law by means of the assessment of governmental performance not only indicates the spirit of rule of law and the value rationality of governmental performance,but also strengthens the instrumental rationality of appraisement as organizational management,helpful in improving the legitimacy of governance.In the future,one should innovate in the appraisement theory,enlarge the participation of the public,introduce multiple estimating subjects,improve technical systems,intensify institutional construction,and develop a performance culture.The change from objective evaluation to the appraisement of performance of governments of rule of law is conducive for the emergence of a new discipline,the studies of appraisements of performance of governments of rule of law,and thus further pushes forwards the multi-disciplinary integration and innovation of public management theory in China.
