哈萨克斯坦的国际商事仲裁制度,具有其自身的优点,主要体现在有较为完整和齐全的仲裁法律制度和体系,仲裁形式多样,力求与国际仲裁规则接轨,在选择仲裁员时允许确立一名候补仲裁员,以及当事人意思自治在某些方面得到充分的体现等。同时,该制度也存在一些不足,如仲裁机构职权不尽统一、法律规定不够细致、国际化进程较为缓慢和仲裁保密性规定不够严密等。
