Foreign Intelligence Surveillance Legislation Comparison and Enlightenment

[目的/意义]情报监听已然成为获取情报的重要手段,需要立法予以规制,有助于我们更深入和高效地开展情报监听。[方法/过程]通过梳理和比较国外在情报监听的立法模式、立法目的、适用范围、监听期限、监听程序、救济措施和资料使用七个方面的异同,为我国立法提供参考。[结果/结论]在结合我国现状的基础上,对情报监听的立法模式选择、立法目的厘定以及立法内容确定进行了设想,以期为我国情报监听立法提供助益。

[ Purpuse/Signitieanee ] Intelligence Surveillance has become an important measure to obtain information, therefore legislative regulation is needed. The legislation can help conduct intelligence surveillance more thoroughly and efficiently. [ Method/Process ] By comparing the foreign intelligence surveillance legislation models, the legislation purpose, scope, surveillance period, procedures, reme- dies and the use of intelligence, the paper provides a useful reference for similar legislation in China. [ Result/Conclusion ] On the basis of combining the present situation of China, the study elaborates the intelligence surveillance legislation mode selection, purpose and content of an ideal intelligence surveillance legislation design for China.
