摘要
网络改变了经济活动和商业行为模式,也使得传统的商标法适用受到新的挑战。我国尚未对商标的合理使用做出系统而详尽的法律规定,但各行政机关和人民法院已经在实践中运用它解决相关纠纷,网络环境下又产生了新的商标权利限制问题。允许合理使用他人商标是对商标权利加以限制的重要制度内容,其目的在于平衡社会公众与权利人之间的利益。在传统领域认定商标合理使用并非易事,而当商品和服务进入互联网时代,商标使用的情形更加多样和复杂,对商标合理使用的认定也更加困难。通过分析我国的立法现状与世界各国的实践经验可以看出:进一步阐明商标合理使用的概念并细化其判断标准,进而将其制度化,具有现实性与必然性,可为我国尽快完善商标合理使用制度提供参考。
The network has changed the mode of economic activity and business behavior,and it also makes the traditional trademark law applicable to new challenges. China does not have detailed law of trademark fair use,but the administrative organs and the people's court use it to resolve disputes,and new trademark rights restriction problem produced under the network environment. Allowing fair use of other people's trademark is an important system to limit the rights of the trademark,which aims to balance the interests between the public and the rights of the people. Recognizing the fair use of trademarks is not easy in the traditional areas. And the use of the trademark is more varied and complex under the Internet environment. Through the analysis of the practical experience of the China's legislation present situation and the rest of the world can be seen: further elucidating concept of trademark fair use and refinement of the judgment standard,with the reality and necessity,providing reference for our country to improve the system of trademark fair use as soon as possible.
