法律工具主义观念的历史发展及其原因分析

The Historical Development and Reasons of Legal Instrumentalism

中国要将法治确立为核心价值观念,必须在实践中超越"法律工具主义"的思想观念。而"法律工具主义"的根系是深深扎在我国传统观念的河床之上的,要肃清其影响,仅仅依靠简单否定的方法是不够的,也不能一味地停留在对法治价值理想的理论论证上,而是需要回到"法律工具主义"观念的思想源头,发现其发展演化的历史轨迹;需要回到新近的法治建设的社会实践当中,追问何以"法律工具主义"畅行的种种原因,才能促成这一转变的发生。

China needs to establish the rule of law as her core values, and we must go in practice beyond the ideolo- gy of ＂legal instrumentalism＂. ＂Legal instrumentalism＂, however, is rooted deeply in our traditional ideas, and if we want to eliminate its impact, method like simple negation is not enough; neither can we cling constantly to theoretical arguments about the ideal value of rule of law. Instead ,we need to trace back to the origin of ＂legal instrumentalism＂ , and find out the evolution of its development. Besides, we need to go back to the recent practice of the legal construction. The pursuit of the reasons to the popularity of ＂legal instrumentalism＂ can make such a shift a real story.
