坦诚对待医疗差错与医患纠纷的处置——以患者安全为视角

Disclosure of Medical Errors and Settlements of Medical Disputes:From the Perspective of Patient Safety

传统医疗差错处理中的"责备文化"不利于及时识别和纠正医疗安全系统中的薄弱环节乃至影响医学事业的发展,因此应当学习美国的公开揭露机制,将对待医疗差错的理念从"风险管理"转换为"患者安全",倡导引入公开揭露机制作为创新医患纠纷和解、调解解决机制的契机,通过确立无过失补偿制度来分担医疗风险,加强对医疗差错监督与管理的制度建设,以建立保障患者了解伤害事实的权益与维护医疗专业自主性的医患纠纷处置方式。

The blame culture in traditional medical error processing cannot help to identify and correct the stark fault in medical security system, sometimes it even sets back the development of health care. The author claimed that the U. S. disclosure mechanism of medical error should be learned and concept of medical errors should be ranged from risk management to patient safety. By advocating disclosure mechanism, the medical dispute conciliation, mediation and settlement will be improved. Furthermore, we should establish the no-fault compensation system to share medical risks and strengthen supervision and management of medical errors so that patients~ right of informed of damage and medical professional autonomy will be protected.
