Damaska's Evidence Law Adrift: Mutual Relationship between Three Procedural Pillars

达马斯卡在《漂移的证据法》一书中提出"支撑英美证据法大厦的三根支柱"为原型审判法庭、集中式程序和对抗制。这种观点的合理性在细致检讨其程序支柱与证据规则的相互衍生和支撑关系之前,甚至首先是检讨这三个支柱之间的相互关系。通过与不同观点的相互比较以及对英美法系诉讼文化背景的考察,这三个支柱之间的确存在着独立性、充分性、关联性和层次性的关系,这三个支柱不独可以解释证据法的过去,还可以因应程序的变化而预测证据法的未来。

In the book ＂Evidence Law Adrift＂, Dama^ka proposes ＂three pillars for British and American evidence law mansion＂, namely trial court, concentrated procedures and op- position system. It is argued that we should examine their mutual impact and support in order to understand their independence, fullness, relevance and layers, and to further know the change of responding procedures and the future of evidence law.
