运用心理咨询技术调解治安案件的探索

Probe into the Application of Psychological Consultation Skills to Mediation of Public-Order-Related Cases

近几年来,中国的经济发展取得了全球瞩目的成绩,社会发展日新月异,随之而来,由劳资、拆迁、债务纠纷引发的打架斗殴和损毁财物的案件明显增多。面对上述案件,单纯采取打击处理的方式解决问题,容易影响社会稳定,造成非正常上访,而治安调解逐渐成为基层公安机关处理化解上述问题的有效手段,可以说成功的调解,既做到了化解矛盾纠纷,又维护了社会稳定。实践中,办理治安调解案件不像办理其他行政、刑事案件那样有章可循,需要民警具备设身处地理解当事人、把控事态发展演化、赢得当事人的信任的能力,特别是需要具有较强的沟通能力、稳定和调解情绪的能力、改变当事人非理性信念的能力。心理咨询为民警提供了一种新的视角和技术手段,从心理咨询技术角度探索治安案件的调解方法具有现实意义。

In recent years, China has made great achievements in economic and social development, which has caught world attention. Subsequently, the disputes involving labor wages, demolition and debts have arisen more frequently. To deal with such cases, pure combat will affect social stability and lead to irrational complaints. However, mediation has gradually become an effective approach that firstline police agencies resort to. Truthfully speaking, successful mediation not only solves disputes but also maintains social stability. In practice, to deal with disputes, which are different from administrative and criminal cases, police officers have no rules to rely on so they should put themselves in the shoes of the parties concerned, try to prevent the disputes from getting worse and have abilities to win their trust, to communicate, to calm down their emotion and to change their irrational beliefs. Psychological consultation offers a new angle of view and technical approach to police. It is significant to explore the application of psychological consultation to mediation of disorder-order-related cases.
