中国刑法学语境下的举动犯探微

举动犯在我国传统刑法学说中是一种犯罪既遂类型。举动犯概念在我国最早由叶高峰教授于《故意犯罪过程中的犯罪形态论》一书中提出。词源意义上，举动犯一词来源于日本刑法学，等同于行为犯。我国刑法学语境下的举动犯实际等同于德国刑法学的企行犯，其是指不存在未遂犯的一种犯罪类型。举动犯与行为犯在构造上具有联系，但在构成要件要素以及犯罪特殊形态上存在区则。举动犯的构成要件缩减性是举动犯构造意义上的特征，举动犯不存在未遂犯是举动犯刑法评价意义上的特征。在我国刑法学说中应当保留举动犯。

In traditional theory , the act crime is a kind of complete crime pattern. The concept of the act crime was put forward by professor Ye Gao feng in his book criminal patterns in the process of intentional crime. In etymology sense, the word of the act crime comes from Japan, which is equivalent to the conduct crime. The act crime in the context of China＇s criminal law is actually equivalent to the ＂unternehmensdelikte＂, which comes from German criminal law concept. The act crime is consistent with the conduct crime on the aspect of crime structure,but there still are some differences in Constitutive elements of crime and crime patterns . The components reduction is the characteristics of the act crime in the construction sense. The act crime doest have abortive formation , which is the characteristics of the act crime in the sense of criminal law evaluation. The act crime should be retained in china＇s criminal law theory.
