Empirical Analysis on the Legal Problems of“Assumption of Risk”

我国虽然没有在法律中规定自甘风险,司法实践中却已经有对自甘风险的运用。为了使该类案件的适用不再混乱,有必要在法律中明确规定自甘风险。从真实案例出发,选取了38个案件,比较分析其适用的肯定判例和否定判例,总结自甘风险适用的领域和条件,明确了自甘风险在竞技体育领域、自助游领域和交通领域的适用。

Although assumption of risk isn＇t regulated in China, it is applied in judicial practice. In order to make these cases unconfused, it is necessary to enacted assumption of risk in the law. The thesis starts from true cases and chooses thirty -eight cases, then contrasts the positive legal precedents to negative legal precedents, then includes the applying fields and applying conditions of assumption of risk, making it clear the applying of assumption of risk in athletic sports filed, self- guided field and traffic field.
