“一带一路”战略下境外直接投资的风险框定研究——基于国际法的识别与分析

A Study on Extraterritorial Direct Investment under One Belt and One Road Strategy——Based on Characterization and Analysis of International Law

随着中国不断拓展、深化"一带一路"战略,中国的境外直接投资将不可避免地面临更多的和更复杂的非市场风险。从深层次的实质根源来看,这些风险往往来源于投资相关各方在利益的认知、诉求和分配上的分歧与矛盾。因此,应建立、完善和充分运用以国际法为基础的国家间合作协调的风险治理机制。为此,根据国际法和国家间协调合作上的考虑,将"一带一路"战略下的境外直接投资风险的基本内容与类型予以识别框定,并进一步明确建立、完善风险治理机制的目标与框架。

When China gradually enlarges and deepens the implementation of One Belt and One Road strategy,Chinese extraterritorial investment will inevitably confront more and much complicated non-market risks. From the perspective of root cause,these risks usually come from divergence and contradiction in the cognition,pursuit and allocation of interest among investors and stakeholders. Therefore we should establish,perfect and fully exploit risk governance mechanism of interstate cooperation and harmonization based on international law. Considering the international law and inter-state cooperation and harmonization,this paper frames basic risk contents and types of extraterritorial direct investment under One Belt and One Road Strategy,and further makes out the objects and framework for the establishment and perfection of risk governance mechanism.
