农村土地确权中的调地问题研究

On Land Readjustment in Determining Land-use Rights

开展承包地确权登记颁证,是中央从深化农村改革全局出发作出的一项重大决策。从各地试点情况看,农村土地确权工作中的土地调整行为较多。土地调整问题政策性、专业性强,社会各界关注度高,处理不好极易引发干群冲突。本文基于陕西省岐山县的案例调查,对土地确权过程中的调地行为进行了分析,并提出在推进土地确权过程中要高度重视土地调整问题,尊重农民意愿,严守所有权主体范围,以维护农民土地权益。

The central government made the decision to carry out the work to determine, register and certify contracted land - use rights in perspective of deepening rural reform. Trials in various areas show that land readjustment is commonplace in determining land - use rights. It involves relevant policies and expertise. Hence, it is a focus of all society, and if improperly handled, it would lead to conflicts between government officials and the people. This paper, based on the case study of Taizi village in Qishan county of Shaanxi Province, analyzes the land readjustment in the process of determining land - use rights and puts forward the proposition that due attention should be given to land readjustment in determining land - use rights to ensure that farmer＇ s wishes be respected, the main scope of ownership will be observed so as to protect farmers＇ rights and interests.
